APPEAL: Supreme Court Victory

The Supreme Court of Louisiana lets the appellate decision stand, resulting in a big procedural win for one of Baer Law’s clients.

In this negligent security case, two lawsuits were filed against Waffle House for a fatal shooting that occurred at one of its restaurants. Baer Law LLC filed the first lawsuit in Orleans Parish and other plaintiffs filed the second lawsuit in a Georgia court. The defendant filed an Exception of Nonjoinder and a Motion for Forum Non Conveniens. The district court judge denied both pleadings. Then the defendant took a writ, asking the Fourth Circuit Court of Appeal to consider these issues. The fourth circuit granted the writ but denied the defendant any of the relief it requested. Then, the defendant took another writ, this time asking the Supreme Court of Louisiana to consider the issues.  The Supreme Court of Louisiana denied the writ, meaning that the plaintiff’s lawsuit can go forward in Orleans Parish while the other case goes forward in Georgia.

Baer Law is proud that it got such a good result for its client at the trial court level, the Forth Circuit Court of Appeal, and the Supreme Court of Louisiana.  Triple win!
